Amnistía, indulto y reconciliación

Cada cierto tiempo aparecen en nuestro país, titulares en los cuales actores políticos o mediáticos solicitan “amnistía”, “indulto” o hablan de forma general sobre reconciliación nacional. Es un tema pendiente en varias de las agendas políticas. La Real Academia de la Lengua Española define amnistía como “olvido legal de delitos, que extingue la responsabilidad de sus autores”. Eximir de responsabilidades a culpables, sin pasar por procesos judiciales justos, ¿acaso fomentaría la reconciliación nacional? Reconciliación no evoca “borrón y cuenta nueva”. Reconciliar implica reconocer o confesar las culpas. Implica también conciliar las diferencias, esto es, llegar a acuerdos o pactos políticos y sociales. En el documento “Instrumentos del Estado de Derecho para Sociedades que han salido de un conflicto”, la oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos estima que amnistías no pueden ser concedidas en casos de delitos imprescriptibles como son violaciones a los derechos humanos. En esos casos, además se señala en este documento, la amnistía no ayuda en los procesos de resolución de conflicto. Al contrario, los agrava porque no rompe con la brecha insondable de las negociaciones y rituales de perdón que deben darse entre las partes involucradas en el conflicto. La amnistía como el indulto siempre va desde el poder central hacia uno o unos individuos que fueron parte del conflicto pero no desde el Estado hacia las poblaciones que vivieron el conflicto. Esa es una gran diferencia.
Desde la caída de la dictadura y el retorno a la democracia se han venido sucediendo una serie de pedidos de amnistía e indulto en el Perú. En los pocos meses que tiene de presidente Ollanta Humala se han dado varias menciones a supuestas amnistías o indultos. Por ejemplo, la Ley de Punto Final a los juicios a militares propuesta del exMinistro de Defensa, Daniel Mora (1), las declaraciones del exMinistro de Trabajo, Rudecindo Vega (2), comentarios más recientes del presidente del Congreso y del nuevo Ministro de Justicia sobre un supuesto pedido de indulto al expresidente Alberto Fujimori. Lo interesante es que estos pedidos provienen desde representantes del Estado, desde representantes del Movimiento por la Amnistía y los Derechos Fundamentales (MOVADEF) (3) piden que se liberen a todos los “presos políticos” y recientemente el congresista Kenyi Fujimori habla de un indulto para su padre. ¿Qué implica tener tantas propuestas de amnistías? ¿Es acaso, el peruano, un ejemplo de proceso transparente de justicia transicional? ¿Por qué la bondad tiene que venir del lado del sufriente, quien acostumbrado a pasar por todo, encima tiene que aceptar propuestas de amnistías o indultos para sacar de la cárcel a quienes cometieron crímenes de lesa humanidad? ¿Por qué indultar al preso Fujimori por razones humanitarias y no así a los cientos de otros presos que se mueren cotidianamente en las cárceles peruanas? ¿Acaso unas “razones” son más humanitarias que otras?
A inicios del año 2011, Jo Marie Burt encargó una encuesta al Instituto de Opinión de la PUCP (4). Ahí se presentan varias respuestas interesantes. Por ejemplo, dos tercios (63,3%) de los encuestados respondieron estar en contra de un indulto y de este grupo 58,8% afirmó que la condena de Fujimori era justa. Sin embargo, 36,6% respondieron a favor de un indulto con razones que evocan aquellas de la “memoria salvadora”. Por otro lado, y aquí citamos a Burt, encuestas que salieron cerca al periodo de la sentencia a Fujimori muestran que el 53,5% de los entrevistaron estuvieron a favor de la sentencia que consideraron justa.
Sin embargo, más allá que el ex Primer Ministro haya considerado estos pedidos como “errores” o que MOVADEF insista en argumentar que lo que hubo aquí fue una “guerra civil” (como ilustra Carlín)(5), o si el congresista Fujimori alude razones humanitarias para solicitar el indulto de su padre, lo que nos preocupa es reflexionar sobre estas diversas propuestas de amnistías e indultos. Mientras nuestra dirigencia política concentra su atención en estos pedidos y en este tipo de declaraciones, las víctimas terminan nuevamente arrinconadas y sus memorias opacadas, los desplazados son doblemente desplazados y los desaparecidos pues simplemente no existen y ni qué decir de los casos de violación y tortura. Se requiere una discusión más profunda sobre la memoria como un campo de batalla y se requiere ver las cercanías que se dan entre aparentemente polos opuestos del espectro político nacional. Los pedidos de amnistía vienen acompañados de lógicas e ideologías conservadoras que buscan en el perdón el camino para la reconciliación sin que medie la negociación, la justicia ni el entendimiento entre las partes. De otro lado, estas discusiones sobre amnistías e indultos también buscan instalar razones (¿históricas?) para contar otras versiones de la historia reciente de nuestro país y así bajo los preceptos de asepsia (limpiar la honra) y la decencia, que son valores usados ampliamente para trazar fronteras simbólicas y raciales de distinción, buscan instalar procedimientos que no son legales ni tampoco democráticos.
