CNDDHH ante la declaratoria de Emergencia en Cajamarca
Ante la declaratoria de estado de emergencia en cuatro distritos de Cajamarca, y la intervención de las FFAA en apoyo de la policía nacional la CNDDHH señala lo siguiente:
1.- Que la declaración de estados de emergencia es una medida excepcional, de acuerdo a la Constitución y a las normas internacionales se justifica “únicamente en caso de guerra, de peligro público o de otra emergencia que amenace la independencia o seguridad del Estado”(1) . Por tal motivo hemos condenado y lo hacemos ahora que se continúe utilizando esta medida en situaciones de protesta social, cuando podría salvaguardarse el orden interno sin necesidad de recortar derechos ciudadanos.
2.- Señalamos que pese a haberse declarado el estado de emergencia, el derecho de reunión y los otros derechos suspendidos no se consideran anulados en forma general, sino solo en relación directa a las razones que han justificado la declaratoria de emergencia. Es decir, las fuerzas del orden pueden impedir que se bloqueen vías de comunicación, o impedir ataques a la propiedad privada, pero no están prohibidas todas las reuniones de la población. Asimismo señalamos que están expeditas las acciones de amparo y hábeas corpus frente a restricciones de derechos que no sean estrictamente proporcionales y razonables.
3.- Solicitamos al Ministerio Público y al Poder Judicial que cumplan su papel de garantes del orden constitucional.
4.- Expresamos nuestra preocupación de que la intervención de las FFAA se realice al amparo del Decreto Legislativo 1095, norma seriamente cuestionada por una acción de inconstitucionalidad en curso. El mantenimiento del orden interno a cargo de las FFAA enfrenta a la población en un entrenamiento y armamento no concebidos para actuar frente a civiles sino en situaciones de guerra.
5.- En tanto que el Estado tiene la obligación de proteger a sus ciudadanos incluso durante situaciones como el Estado de Emergencia, según los tratados internacionales y el marco constitucional es responsabilidad directa del Presidente de la República cualquier situación de grave vulneración de derechos.
6.- Invocamos al gobierno a dar una solución de fondo y de largo plazo a los conflictos socioambientales en el país, garantizando la existencia de una institucionalidad ambiental fuerte, independiente, dotada de recursos técnicos y financieros, implementando a la brevedad el derecho a la consulta previa e informada respetando estrictamente los principios mínimos del derecho internacional, y efectuando a la brevedad el ordenamiento territorial del país con la participación plena de la población.
